“JOIN INSIDE CURVES $500 GIFT CARD” SWEEPSTAKES
The following Sweepstakes is intended for play in the United States only, and shall only be construed and evaluated according to U.S. law. Do not enter this Sweepstakes if you are not located in the U.S. at the time of entry.
1. NO PURCHASE NECESSARY. A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING.
Sweepstakes is open and offered only to legal residents of the 50 United States and Washington D.C., who are 18 years of age and older as of July 27, 2009. All entries submitted online as described below have an equal chance of winning. Employees and their immediate families (parent, child, sibling or spouse) and/or household members of each of Charming Shoppes of Delaware, Inc (“Sponsor”), its respective parents, subsidiaries, affiliates, distributors, sales representatives, advertising and promotional agencies and any other persons or entities associated with this promotion are ineligible to enter or win. By participating, you agree to abide by and be bound by these Official Rules. Void in Puerto Rico and where prohibited by law.
2. HOW TO ENTER:
Between 12:01 a.m. Pacific Time on July 27, 2009 and 11:59 p.m. Pacific Time on November 1, 2009 (“Sweepstakes Period”), access www.lanebryant.com/insidecurve and follow the entry instructions. Complete all information requested in the information fields. When your entry is complete, click on the area marked “Enter Sweepstakes” (once submitted, entry cannot be deleted canceled or modified). Entries must originate through www.lanebryant.com to be eligible. Limit of one entry per e-mail address. Enter using only an e-mail address subscribed and registered in your name. In the event of a dispute as to entries submitted by multiple individuals using the same e-mail account, subscriber is deemed to be the natural person who is assigned an e-mail address by an Internet access provider, online service provider or other organization which is responsible for assigning e-mail addresses or the domain associated with the submitted e-mail address.
Sponsors are not responsible for late, incomplete, illegible, delayed entries. Incomplete information may result in disqualification of entry. 3. PRIZE DETAILS AND ODDS OF WINNING:
Nine (9) Grand Prize Winners, upon confirmation of eligibility will receive $500 Lane Bryant Gift Card. Total prize pool ($4,500). Odds of winning are based upon the number of eligible entries received.
4. DRAWING AND AWARDING OF PRIZE(S):
Winner will be selected in a random drawing from among all eligible entries received, to be conducted on or about November 15, 2009, by Sponsor, or authorized representative of Sponsor, whose decisions are final on all matters relating to this Sweepstakes. Winner will be notified by e-mail, mail and/or phone, and Grand Prize Winner will be required to complete and execute an affidavit of eligibility/compliance/liability release, and, where lawful, a publicity release, to be returned within fourteen (14) days of the date notice is sent. Failure to return all required paperwork within this stated time period may result in the forfeiture of the prize and an alternate winner will be selected. All prizes will be awarded assuming a sufficient number of eligible entries are received. Prizes returned as undeliverable or otherwise not claimed within fourteen (14) days after delivery of notification will be forfeited and awarded to an alternate winner. Prizes cannot be substituted, except as provided herein. Sponsor reserves the right to substitute Prize with one of equal or greater value should feature Prize become unavailable. Prizes are not transferable and may not be exchanged for other prizes or for cash. All federal, state and local taxes are sole responsibility of Winner.
5. GENERAL:
By accepting a Prize, where permitted by law, Winner grants to the Sponsor, its respective parents, subsidiaries and related companies, and those acting pursuant to the authority of Sponsor (which grant will be confirmed in writing upon Sponsor’s request), the right to print, publish, broadcast and use worldwide IN ALL MEDIA without limitation at any time the Winner’s full name, portrait, picture, voice, likeness and/or biographical information for advertising, trade and promotional purposes without further payment or additional consideration, and without review, approval or notification. IN NO EVENT WILL SPONSOR, ITS RESPECTIVE PARENTS, AFFILIATES, SUBSIDIARIES, ADVERTISING AND PROMOTION AGENCIES, DEALERS, DISTRIBUTORS, SUPPLIERS, PRIZE PROVIDER AND THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, REPRESENTATIVES AND AGENTS BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND (INCLUDING WITHOUT LIMITATION, DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES) ARISING OUT OF PARTICIPATION IN THIS SWEEPSTAKES OR THE ACCEPTANCE, POSSESSION, USE, OR MISUSE OF, OR ANY HARM RESULTING FROM THE ACCEPTANCE, POSSESSION, USE OR MISUSE OF THE PRIZES. By participating, entrants release and agree to hold harmless the Sponsor, its respective parents, affiliates, subsidiaries, advertising and promotion agencies, dealers, distributors, suppliers, Prize provider and their respective directors, officers, employees, representatives and agents from any and all liability for any injuries, death or losses or damages to persons or property AS WELL AS CLAIMS/ACTIONS BASED ON PUBLICITY RIGHTS, DEFAMATION, AND/OR INVASION OF PRIVACY that may arise from participating in this Sweepstakes or its related activities or the acceptance, possession, use or misuse of , or any harm resulting from the acceptance, possession, use or misuse of the Prize(s). Sponsor is not responsible for incorrect or inaccurate entry information, whether caused by any of the equipment or programming associated with or utilized in the Sweepstakes, or by any technical or human error, which may occur in the processing of the Sweepstakes entries. Sponsor is not responsible for interrupted or unavailable network server or other connections, miscommunications, failed telephone or computer transmissions or jumbled, scrambled or misdirected entries or transmissions, or for phone, electrical, network, computer hardware or software or program malfunctions, failures or difficulties or for other errors, omissions, interruptions, or deletions of any kind whether human, mechanical or electronic or for any damage to any person’s computer related to participating in the Sweepstakes. Any personally identifiable information collected during an entrant's participation in this promotion will be collected by Sponsor and used by, its respective parents, its affiliates, agents and marketers for purposes of the proper administration and fulfillment of the Sweepstakes and for marketing purposes as described in these Official Rules and in accordance with Sponsor's Privacy Policy as stated at http://lanebryant.charmingshoppes.com/pagebuilder/privacy_policy. The interpretation of these Official Rules shall be governed by the laws of the Commonwealth of Pennsylvania. Sponsor will be collecting personal data about entrants online, and e-mail addresses from entry forms in accordance with its Privacy Policy. By participating in the Sweepstakes and providing your e-mail address, entrants hereby agree to Sponsor’s collection and usage of their personal information and acknowledge that they have read and accepted Sponsor’s Privacy Policy.
7. WINNER LIST:
For the name(s) of the Prize Winner(s), send a self-addressed, stamped business-size (#10) envelope to: Winners List- ASC/”Join Inside Curves $500 Gift Card” Sweepstakes, 300 State St., Suite 402, Rochester, NY 14614. Winner names will be sent after selection of Winner.
